Any employee whose employment contract has been broken and is covered by unemployment insurance can benefit from maintaining the health and welfare supplemental coverage available to him at his former employer. How? And for how much time?
How long?
This continuation coverage is available for a period equal to that of his employment contract, with a maximum of 9 months. It starts from the date of termination of the employment contract.
All additional guarantees health and welfare which the employee already had with his former employer are kept: disability, incapacity, death ...
Who is affected?
This possibility is offered to all employees:
-With rights to unemployment.
-Justify at least a month of work in their previous company.
All types of contracts are involved: CDI, CDD or interim termination. CSD only very short-term are excluded from this right, since the waiting period (4 to 6 months) of certain complementary health.
How to proceed?
The employee must be compensated by unemployment insurance and provide his former employer proof of support by the employment center.
The employee must request from his former employer to benefit from maintaining its health and welfare coverage. It may also waive the maintenance of his rights by informing his former employer within 10 days after the end of his employment contract. This waiver is final and all the guarantees for health and welfare.
